moment zero Terms of Service

Effective Date: August 27, 2026

These Terms of Service ("Terms") govern your access to and use of moment zero, including its website, Adventures, QR codes, other physical or digital Markers, invitations, routes, challenges, leaderboards, reports, communications, and related services.

By using moment zero or participating in a moment zero Adventure, you agree to these Terms.

If you do not agree, do not use moment zero.

1. About moment zero

moment zero provides interactive experiences that may combine digital services with real-world locations and activities.

An Adventure may involve:

traveling between locations;
scanning QR codes or interacting with other physical or digital Markers;
completing Milestones, RouteSteps, puzzles, or challenges;
following instructions or clues;
competing or comparing results;
inviting or referring other participants;
interacting with participating businesses, organizations, public spaces, or other locations; and
submitting reports or other information relating to an Adventure.

Each Adventure may have additional instructions or rules.

2. Eligibility

You may use moment zero only if you are legally permitted to do so and can comply with these Terms.

If you are a minor, you should use moment zero only with the permission and appropriate supervision of a parent or legal guardian.

Some Adventures may impose additional age, eligibility, participation, or supervision requirements.

3. Physical Activity and Personal Responsibility

moment zero Adventures may involve travel, walking, hiking, driving, visiting public or private locations, outdoor activity, or other real-world activity.

You are responsible for your own safety and decisions.

You agree to:

obey traffic laws and other applicable laws;
never use moment zero in a way that distracts you while driving;
use appropriate caution around roads, vehicles, terrain, weather, wildlife, construction, and other hazards;
respect posted signs, closures, operating hours, and property boundaries;
not trespass or enter unsafe or unauthorized areas;
determine whether an activity is appropriate for your abilities and circumstances; and
supervise minors in your care appropriately.

A moment zero clue, Marker, route, instruction, or digital indication is not a guarantee that a location or activity is currently safe, accessible, open, authorized, or appropriate.

Real-world conditions may change after an Adventure is created or reviewed.

If real-world conditions conflict with an Adventure instruction, follow the safer course of action.

4. Adventure Rules

Individual Adventures may contain additional rules, instructions, eligibility requirements, scoring methods, time limits, route assignments, or other conditions.

You agree to follow the rules presented for the Adventure in which you participate.

Adventure rules form part of these Terms for that Adventure.

5. Accounts and Authentication

Some features may require or support authentication.

If you use Google Sign-In or another authentication method, you are responsible for maintaining control of the account you use.

You may not:

impersonate another person;
improperly access another user's account or participation;
share credentials in a way that permits unauthorized access; or
circumvent account, role, or access restrictions.

Connecting an account to existing Adventure participation may allow supported participation information to remain associated with that account.

Staff, administrator, collaborator, and reviewer access may carry additional permissions and responsibilities. You may use privileged access only for authorized purposes.

6. Anonymous and Pseudonymous Participation

Some moment zero Adventures may allow participation without a traditional user account.

moment zero may assign an anonymous or pseudonymous Explorer identifier, Adventurer number, or similar identifier and use browser sessions or similar technologies to recognize your participation and preserve Adventure progress.

These identifiers do not necessarily represent a unique individual. A person may, in some circumstances, create or use more than one participation identity or Run.

Loss of browser data, cookies, devices, or sessions may affect our ability to recover anonymous Adventure progress.

7. QR Codes, Markers, NFC, Links, and Invitations

moment zero may use QR codes, NFC or other physical or digital Markers, links, invitations, or other tokens to provide access to Adventures or Adventure functionality.

You may not:

alter, remove, damage, or deface physical Markers without authorization;
deliberately interfere with another participant's ability to use a Marker;
create fraudulent or misleading moment zero Markers;
relocate a Marker without authorization;
use private or restricted invitations without authorization;
circumvent Adventure access restrictions; or
manipulate QR codes, links, Markers, invitations, or tokens to gain unauthorized access or falsify participation.

moment zero may revoke, replace, disable, relocate, or modify Markers, invitations, or access mechanisms when reasonably necessary.

8. Fair Play and Adventure Integrity

Some Adventures may include scoring, leaderboards, rankings, Influence, referrals, prizes, recognition, or other competitive or progression-based features.

You agree not to manipulate these systems through fraud, automation, false referrals, unauthorized Marker or link sharing, fabricated participation, technical exploitation, intentional falsification of progression, or other deceptive behavior.

moment zero may use operational or technical evidence to identify unusual activity for review.

Such evidence or an integrity flag does not necessarily establish that misconduct occurred.

Where reasonably necessary to maintain Adventure integrity, moment zero may investigate, flag, exclude, correct, invalidate, or remove results that we reasonably believe are fraudulent, technically corrupted, improperly obtained, or inconsistent with applicable Adventure rules.

9. Reports, Contact, and Communications

moment zero may provide features that allow you to report Marker problems, inaccessible locations, safety concerns, technical issues, or other Adventure-related problems, or to submit questions, feedback, or other communications.

You agree to provide reports and communications in good faith and not knowingly submit materially false, abusive, unlawful, or misleading information.

If you provide a contact email address, or if your participation is associated with an account containing an email address, moment zero may use that address to respond to your submission or provide relevant status updates.

Submitting a report does not guarantee that moment zero will immediately inspect, repair, replace, close, or otherwise act on a Marker, location, or Adventure.

If you encounter an immediate safety risk, do not rely on a moment zero report as a substitute for taking appropriate safety precautions or contacting emergency services or the responsible property owner or authority when appropriate.

10. Availability and Changes

moment zero is an evolving service.

We may modify, suspend, replace, or discontinue features or Adventures.

Adventure locations, routes, Markers, businesses, clues, availability, and real-world conditions may change without notice.

We do not guarantee that:

every Adventure will remain continuously available;
every Marker will remain present, functional, or accessible;
every route or location will remain unchanged;
Adventure progress can always be recovered;
rankings or scores will remain unchanged after integrity review;
reports or support requests will receive an immediate response; or
moment zero will operate without interruption or error.

11. Third-Party Locations and Services

Adventures may involve locations, businesses, organizations, websites, or services that moment zero does not own or control.

Unless expressly stated otherwise, inclusion in an Adventure does not mean that a third party sponsors, endorses, operates, approves, or assumes responsibility for moment zero or a particular Adventure.

You are responsible for complying with applicable rules, policies, hours, access restrictions, and instructions imposed by third parties.

moment zero does not grant permission to enter property or access a location where permission would otherwise be required.

12. Acceptable Use

You may not use moment zero to:

violate applicable law;
harm, threaten, harass, or deceive others;
trespass or damage property;
interfere with moment zero systems or physical Adventure infrastructure;
gain unauthorized access to accounts, Adventures, participant information, or administrative functionality;
introduce malicious software or code;
scrape or automate access in a manner that harms, overloads, or improperly exploits the service;
exploit technical vulnerabilities;
manipulate competitive or progression results;
submit intentionally false or abusive operational reports;
obtain or disclose information without authorization; or
use the service in a way that creates unreasonable safety, security, or operational risks.

13. Intellectual Property

moment zero and its associated software, branding, designs, Adventure content, graphics, text, puzzles, clues, and other materials may be protected by intellectual property laws.

Except where expressly permitted, these Terms do not grant you ownership of moment zero intellectual property.

You may use moment zero materials only as reasonably necessary to participate in or administer authorized moment zero experiences.

Nothing in these Terms prevents you from engaging in uses permitted by applicable law.

14. Feedback

If you voluntarily provide ideas, suggestions, or feedback about moment zero, you permit us to use that feedback to operate, improve, and develop the service without obligation to compensate you.

This does not transfer ownership to moment zero of personal information or other material that cannot lawfully be assigned in this manner.

15. Privacy

Your use of moment zero is also governed by the moment zero Privacy Policy.

The Privacy Policy describes information that may be collected through Adventure participation, account features, reports, communications, technical operation, security, and integrity-related functionality.

16. Disclaimer of Warranties

To the extent permitted by law, moment zero is provided on an "as is" and "as available" basis.

We do not guarantee that the service, an Adventure, a location, a Marker, a route, a clue, or information presented through moment zero will always be available, accurate, safe, authorized, accessible, uninterrupted, or error-free.

Information about real-world locations may become outdated or inaccurate because of conditions outside our control.

Nothing in moment zero should replace your own judgment regarding real-world conditions, property access, personal safety, or the need to follow instructions from responsible authorities.

17. Limitation of Liability

To the fullest extent permitted by applicable law, moment zero and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of moment zero.

To the extent permitted by law, moment zero is not responsible for injuries, losses, property damage, accidents, access restrictions, closures, or other harm resulting from conditions or activities outside our reasonable control, including your decisions while participating in real-world activities.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

18. Suspension or Termination

We may restrict or terminate access to moment zero when reasonably necessary to:

protect participants or others;
maintain Adventure integrity;
address abuse or unauthorized access;
enforce these Terms or applicable Adventure rules;
comply with law; or
protect the service, its operators, or its infrastructure.

We may also invalidate or restrict affected Adventure participation or results where reasonably necessary for these purposes.

You may stop using moment zero at any time.

19. Changes to These Terms

We may update these Terms as moment zero evolves.

The effective date at the top indicates when these Terms were last updated.

If changes are material, we may provide additional notice where appropriate.

Continued use after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

20. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles, except where applicable law requires otherwise.
